The commercial relations of Grand Sud Formation, hereinafter referred to as the educational institution, are governed by these Terms and Conditions. Grand Sud Formation reserves the right to modify the Terms and Conditions of Sale and Use at any time, it being specified that those applicable are those in force on the date of registration.
These General Terms and Conditions of Sale and Use (hereinafter referred to as "GTC," "GTCU," or the "Agreement") are entered into between Grand Sud Formation (SIRET: 94212165800028 – Address: 21 rue du Village d'Entreprises – BAT 6 – 31670 LABEGE), a SUPDEFORM school, registered in the Lyon Trade and Companies Register under number 942121658, and the person who registers for a training course organized by the company (hereinafter the learner).
The training course in question is the one listed on all communication materials (brochures, website, etc.).
The services offered for sale are described and presented as accurately as possible on the website and in the brochures. However, the company cannot be held liable for minor variations in the presentation of the services, nor do such variations affect the validity of the sale. Grand Sud Formation reserves the right to correct the content of the website and/or brochures at any time.
In accordance with the provisions of Article L 221-18 of the Consumer Code, the learner, represented by his or her legal representative(s), has a withdrawal period of fourteen (14) days from the conclusion of the Contract to withdraw from his or her commitment and send the educational institution a clear and unequivocal statement of his or her intention to withdraw.
This right of withdrawal may be exercised by email or by registered letter with acknowledgment of receipt, sent to the address indicated in the header of the signed contract. If exercised within the aforementioned period, the right of withdrawal will result in the refund of all payments received. No sums or compensation will be required.
5.1.1 Force majeure: if the learner is unable to fulfill their contractual obligations due to a duly recognized case of force majeure, the Contract may be terminated early. Training fees paid up to notification will be refunded on a pro rata basis. Notification must be made by registered letter with acknowledgment of receipt, accompanied by all supporting documents.
5.1.2 Legitimate reasons: the Contract may be terminated early when the learner is forced to move more than 100 kilometers from the institution, when faced with a serious illness or disability in a relative requiring their presence, or when faced with the death of a family caregiver. Fees will be refunded on a pro rata basis for services not yet provided.
5.1.3 Withdrawal by the learner: before the start date, training fees paid in advance will be refunded and only registration fees retained, except in cases of force majeure. After the start of the course, fees for each commenced period remain due according to the terms defined in the Agreement.
5.2.1 Force majeure: if the institution is unable to fulfill its obligations due to force majeure, fees will be refunded on a pro rata basis.
5.2.2 Non-payment: after an unsuccessful formal notice within fifteen (15) days, the institution may terminate the Contract at the learner's expense.
5.2.3 Permanent exclusion: in the event of permanent exclusion under the internal regulations, the learner must pay the full training fees for the current year.
5.2.4 Cancellation of courses: if fewer than twelve (12) learners are enrolled, the institution may cancel before the start date and refund all payments. After the start, fees are refunded on a pro rata basis for hours not provided.
Rates include registration fees and training fees. They are listed on the website in euros, net of charges. Training fees may be paid in cash or in installments.
Training fees do not include additional costs remaining the learner's responsibility (textbooks, materials, transportation, food, lodging, organized trips, etc.).
Registration fees remain definitively acquired by the institution, subject to the applicable 14-day right of withdrawal.
In accordance with Article L. 841-5 of the Education Code, the student and campus life contribution is paid by each learner with student status on the portal defined by order of the Minister responsible for higher education.
Exam registration fees are included in the cost of the first training session. Depending on the qualification presented, a candidate who has failed may retain marks for a period determined by the certifying body and may sit new exam sessions. The cost of registering for a new session varies depending on the qualification.
